General Terms and Conditions (GTC)

1. Scope of Application

Golf Limpachtal brings together shareholders of Public Golf Bucheggberg AG (PGB) (hereinafter referred to as “Shareholders”) and various categories of annual members.

These General Terms and Conditions (GTC) apply to all shareholders and annual members. Shareholders and annual members are hereinafter jointly referred to as “Member” or “Members”.

All Members acknowledge and accept the applicable regulations of Golf Club Limpachtal as well as these GTC.

Upon conclusion of a playing rights agreement, shareholders additionally acknowledge the statutes of GLBV and PGB.

2. Admission Requirements

Membership may generally be granted to individuals holding a valid playing ability certificate in accordance with the regulations of Swiss Golf.

3. Rules and Etiquette

Members must comply with all club regulations, local course rules, general golf etiquette and instructions issued by the responsible bodies (management, marshal, board, tournament committee, etc.).

Violations may result in disciplinary measures.

4. Membership and Fees

Membership is personal and non-transferable.

Members are required to pay:

  • A playing rights fee
  • A club membership fee
  • A Swiss Golf licence fee

Fees are determined annually by the responsible bodies. They apply per calendar year and are independent of the date of entry or resignation. Refunds of any kind (including pro-rata refunds) are excluded.

Upon payment of the annual fees, Members receive their personal membership card indicating name, Swiss Golf ID number, handicap index, PIN and year of validity.

In case of loss, a replacement card may be issued for an administrative fee of CHF 30.00.

Members are only entitled to play on the course once the annual fees have been fully paid. If payment is not received after the second reminder, membership may be terminated at the discretion of Golf Limpachtal.

5. Shareholder Passive Status

Shareholders may apply for passive status (Shareholder Passive Membership). In passive status, shareholders are generally not entitled to playing rights.

Passive status must be requested in writing by December 31 of the current calendar year for the following year. Passive status is valid for one calendar year and must be renewed annually.

Passive members are required to pay a passive contribution. They are exempt from paying the Swiss Golf licence fee and the club membership fee during the passive year.

6. Fee Structure

The tariff structure of all fees (including passive contributions) is reviewed annually by the responsible bodies and may be adjusted accordingly.

Different membership categories may be introduced, modified or abolished. Applicable tariffs are published in the usual manner.

7. Termination and Renewal

Resignation at the end of a calendar year or transfer to a lower membership category must be submitted in writing by October 31 of the current calendar year.

If no written notice is received by this date, membership automatically renews for the following calendar year and the full annual fee becomes due.

Transfer to another membership category (e.g. age-related) takes effect at the beginning of a new season, provided that the member has not submitted written resignation by October 31. The year of birth is decisive for category changes.

8. Refusal or Withdrawal of Membership

Golf Limpachtal reserves the right to refuse membership applications or to withdraw membership without stating reasons (e.g. disciplinary violations, non-payment of fees, etc.).

9. Liability, Insurance and Compliance

Use of the golf facilities is at the Member’s own risk.

Public Golf Bucheggberg AG (PGB) accepts no liability for theft or loss of personal belongings.

Each Member is responsible for maintaining adequate insurance coverage for the use of the facilities and participation in events organized by PGB.

10. Amendments to the GTC

Golf Limpachtal reserves the right to amend these GTC.

Amendments or additions become part of the contractual relationship unless the Member objects in writing within 30 days of being informed of the changes.

11. Severability Clause

If any provision of these GTC is invalid or incomplete, or if performance becomes impossible, the validity of the remaining provisions shall remain unaffected.

The invalid provision shall be replaced by a legally permissible provision that comes closest to the intended economic purpose. The same applies in case of contractual gaps.

12. Applicable Law and Jurisdiction

These GTC are governed by Swiss substantive law.

Place of performance and exclusive jurisdiction is the registered office of Public Golf Bucheggberg AG (PGB).

In case of discrepancies between the German and English versions of these GTC, the German version shall prevail.
